1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The learned counsel for the petitioners, at the outset, seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.1, Bhola Mian @ Anullah @ Anullah Mian @ Mo. Anulah as he was arrested during pendency of the instant anticipatory bail application.

3. Permission is accorded.

4. Accordingly, instant petition is dismissed as withdrawn with respect to petitioner no.1, Bhola Mian @ Anullah @ Anullah Mian @ Mo. Anulah as having become infructuous.

5. The petitioner no.2 seeks bail in anticipation of her arrest in a case registered for the offences punishable under Sections 147, 148, 149, 342, 302, 323 and 504 of the Indian Penal Code.

6. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a woman. It is next submitted that Ajay Jaiswal @ Ajay Jaishwal @ Ajay Kumar Jaiswal had approached this Court seeking anticipatory bail by filing Cr. Misc. No.17707 of 2025 and the same was allowed by an order dated 23.07.2025. It is further submitted that the case of the petitioner is on the better footing and no specific allegation of assault is alleged against her and is a woman.

7. Learned A.P.P. opposes the anticipatory bail application.

8. Considering the submissions and taking into consideration the order dated 23.07.2025 in Cr. Misc. No.17707 of 2025, the petitioner no.2, above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on her furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.18191 of 2025(3) dt.23-07-2025 3/3 each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Pakaridayal P. S. Case No.144 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

9. The application stands allowed.
