JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47a of the Excise Act.
It is alleged that 1000 sachets of country made liquor were recovered from an auto rickshaw when two persons, namely, Mantu Kumar and Praveen Kumar, carrying the liquor, were apprehended. Co-accused Mantu Kumar in his confession suggested that the alleged liquor was carrying to the shop of this petitioner and Ramashankar Bhagat.
It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and the petitioner has been roped in the present case on confession of co-accused Mantu Kumar. Moreover, there is nothing on record to suggest that seized
Patna High Court Cr.Misc. No.33442 of 2015 (2) dt.13-08-2015 2/2 liquor were being transported to the shop of the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No.157 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
