The petitioner being the husband of the complainant is apprehending his arrest in a complaint case wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 323, 494 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.
The basic accusation is of torture for nonfulfillment of the dowry demand and performing second marriage.
Patna High Court Cr.Misc. No.33931 of 2015 (2) dt.13-08-2015 2/2 Considering the fact that complaint was filed in 2005, this Court is not inclined to entertain the present application, but since the petitioner is ready to settle the dispute, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Complaint Case No. 615 of 2005 pending in the court of learned SDJM, Madhepura.
With the aforesaid observation, this application is disposed of.
