The petitioner seeks bail in a case instituted under Sections 328, 379 and 307 of the Indian Penal Code. The prosecution case, in brief, is that some unknown persons had taken clothes, mobile, ATM card and cash of Rs. 4000/- from the informant, after administered intoxicated material in his cold drink, while he was traveling in Amrapali Express. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.09.2015. The charge has been framed in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the First Information Report. The name of the petitioner

Patna High Court Cr.Misc. No.32001 of 2016 (4) dt.22-09-2016 2/2 has come in the confessional statement of co-accused before the police. The petitioner has not been put on Test Identification Parade. No recovery of any theft article has been recovered from the possession of the petitioner. The other co-accused has been granted bail vide Annexure-2 to the present application. On behalf of the state it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Katihar, in connection with Sessions Trial No. 23 of 2016, arising out of Katihar Rail P.S.
