2. The petitioner is apprehending his arrest in connection with Complaint Case No. 2363 of 2019 for the offence under section 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act lodged by the complainant, Halen Devi.
3. As per the complainant, the marriage took place in the month of June 2019 but she was always tortured for dowry in between, three children came in this world who are around six years, three and a half years and two years. As the torture continued, the complaint.

4. Earlier, the Coordinate Bench sent the matter to the Mediation Center but as per the report dated 22.08.2025, it failed.

Learned counsel for the petitioner submits that till an order comes from a competent Court, he is ready to cater to the needs of the lady as also the three children inasmuch as Rs. 3,000/- for the lady and Rs. 1,000/- each for the three children (totalling Rs. 6,000/-) which shall be deposited in her bank account (the details of which to be provided by the lady) directly by 10th of every month.
6. Learned counsel for the complainant opposes the prayer submitting that she alongwith three children have been made homeless by the petitioner.

Considering the submissions of the parties as also the allegation that has come, though the petitioner is not fit to get the relief but considering that he has offered economic help to the lady and the children, this Court is inclined to extend him the privilege of anticipatory bail with conditions which is subject to the payment of Rs. 6,000/- per month by the 10th of every month in the bank account of the lady failing which the lady shall be free to take steps for
3/4 cancellation of the bail bond.
8. It has been informed that the maintenance case has been filed by the lady. If any such petition is there, this order will merge with the final order passed by the Family Court regarding maintenance.

Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned J.M. 1st, Katihar in connection with Complaint Case No. 2363 of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself; (iii) the petitioner shall in no way try to induce or
4/4 promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Adnan/- U T
