The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 414, 467, 468, 471, 420/34 of the Indian Penal Code.

The prosecution case is that suspected stolen motorcycle was recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled and seizure list witnesses have suggested that the signature was obtained on blank paper. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.35249 of 2015 (2) dt.20-08-2015 2/2 consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner keeping in view of the fact that the petitioner has no criminal antecedent, if the petitioner surrenders within a period of six weeks in connection with Ghanshyampur P.S. Case No.22 of 2015, pending before the learned Judicial Magistrate, 1st Class, Biraul at Benipur, Darbhanga. With the above observation, this application is, accordingly, disposed off.
