JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323 and 353/34 of the Indian Penal Code and 135 of the Indian Electricity Act. The prosecution case is that the Junior Electrical Engineer, Electricity Department, Suapul raided the premises of Kedar Nath Jain when he found that against the sanction load of 1 KW, 4 KW energy were consumed. The further case of prosecution is that at the time of raid the petitioner being the tenant of Kedar Nath Jain and others abused and assaulted the informant.

It is submitted by learned counsel for the petitioner that the petitioner was not the tenant of Kedar Nath Jain rather he was the tenant of Bhushan Pd. Singh and the accusation is omnibus

Patna High Court Cr.Misc. No.34278 of 2015 (3) dt.18-09-2015 2/2 and general. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. It is submitted by Mr. Vinay Kirti Singh, learned counsel for the North Bihar Power Holding and Distribution Company that accusation of abusing and assaulting the informant is specific against the petitioner.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul in connection with Supaul P.S. Case No. 70 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
