This is a petition for grant of regular bail in connection with Falka (Phthiya) Falka P.S. Case No. 278 of 2017 for offences under Sections 302 and 201/34 of the Indian Penal Code.
Allegation, in brief, is that the dead body of the deceased was found thrown by the side of the road. The learned counsel for the petitioner submits first information report is against unknown and the only material against the petitioner is that he is said to have been last seen with the deceased going in an ambulance and this was disclosed in the confessinoal statement of one Suraj Prakash, except that there is no material against the petitioner and similarly situated another co-accused, Manish Kumar Singh, was granted bail by
Patna High Court Cr.Misc. No.63569 of 2017(5) dt.09-03-2018 2/2 this Court in Cr. Misc. No. 1399 of 2018.
Having considered the facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Falka (Phthiya) Falka P.S. Case No. 278 of 2017 to the satisfaction of the Additional Chief Judicial Magistrate, V, Katihar. (Arun Kumar, J) Shamshad/- U T
