11-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner, in the present case, is seeking regular bail in connection with Sessions Trial No. 45 of 2017 arising out of Hussainganj P.S. Case No. 43 of 2016 registered for the offence punishable under Sections 307/34 of the Indian Penal Code and 27 of the Arms Act pending in the court of learned Additional District Judge - IV, Siwan. It appears from perusal of the record that this petitioner has got criminal history, inasmuch as six cases are mentioned in the order and all are in relation to commission of serious and heinous crimes. In the impugned order, learned Sessions Judge - IV, Siwan has quoted the statement of the injured who has specifically named this
Patna High Court Cr.Misc. No.117 of 2018 (2) dt.11-01-2018 petitioner as assailant.
Learned Additional Public Prosecutor for the State opposes the prayer for bail of the petitioner. Considering the facts and circumstances emerging out from the records, I am not inclined to grant regular bail to the petitioner.
Accordingly, prayer for regular bail of the petitioner is rejected. However, learned trial court is directed to expedite the trial of this case.
