JUSTICE ASHUTOSH KUMAR ORAL ORDER 27-03-2019 The petitioner seeks modification of the order dated 25.01.2019 passed in Cr. Misc. No. 61927 of 2018 whereby he was granted bail in the event of his surrender before the court below within a period of four weeks from the date of passing of the order.

Learned counsel for the petitioner has submitted that because of unavoidable circumstances, the petitioner could not surrender before the court below within the stipulated time.

Under the circumstances, a prayer for extension of time has been made in the present petition.

This Court is satisfied about the grounds which

Patna High Court CR. MISC. No.15779 of 2019(2) dt.27-03-2019 2/2 prevented the petitioner from appearing before the court below for grant of bail as directed by this Court. For the aforementioned reasons, the order dated 25.01.2019 passed in Cr. Misc. No. 61927 of 2018, is modified to the extent that in case the petitioner surrenders before the court below within a period of four weeks from today, he shall be granted bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-cum-Additional Chief Judicial Magistrate, Patna City in connection with Didarganj P. S. Case No. 86 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The order stands modified accordingly and the petition is disposed of.
