The petitioner apprehends his arrest in Vishambharpur P.S. Case No.03 of 2021, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 10 litres of illegal wine is said to have been recovered from the room of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is not apprehended at the spot. The petitioner has got no criminal antecedent as stated in para 3 of the bail petition.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Patna High Court CR. MISC. No.29207 of 2021(2) dt.17-12-2021 2/2 Having considered the fact that 10 litres of illegal wine has been recovered from the room of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
