JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Benipatti P.S. case no. 19 of 2018 for the offence under Sections 406, 409, 467, 468, 471, 420/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Referring to the order passed by a Co-ordinate Bench of this Court dated 30.08.2018 in Cr. Misc. No. 44171 of 2018 he submits that the co-accused Ram Babu Yadav received Rs. 79,00,000/- has been granted anticipatory bail. He further submits that the petitioner, who is the husband of the Mukhiya, has no role in the matter. Learned counsel for the petitioner admits that the Mukhiya is still in custody and the petitioner being the husband of the Mukhiya deserves bail.

No.54769 of 2018 (2) dt.28-09-2018 2/2 Considering the fact that co-accused has been granted anticipatory bail by a Co-ordinate Bench of this Court, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each after 21.10.2018 to the satisfaction of Additional Chief Judicial Magistrate, Benipatti, Madhubani in connection with Benipatti P.S. case no. 19 of 2018 with the condition that the bailors should be the family members of the petitioner.
