JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Learned counsel for the petitioner is permitted to make necessary correction in para 9 of the bail application. Heard learned counsel for the petitioner and State. The petitioner is custody in connection with Excise case no. 131 of 2018 for the offence under Sections 2 (c), 3, 5, 13 of the Bihar Mahua Flower Act, 2006 and Sections 30 (C), 37(b) of the Bihar Excise and Prohibition Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. The petitioner is in custody since 07.08.2018 in connection with seizure of 40 Kg. Mahua flower. He submits that the Mahua flower is used for fodder and as such the custody of the petitioner in the instant case is uncalled for.

No.54681 of 2018 (2) dt.20-09-2018 2/2 Considering the totality of the facts situation, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Gaya in connection with Excise case no. 131 of 2018.
