The petitioner seeks bail in connection with Bathnaha P.S. Case No. 290 of 2017 instituted for the offence under Section(s) 363/366A/34 of the Indian Penal Code. Learned counsel for petitioner has submitted that victim girl, on recovery, has given her statement under Section 164 Cr.P.C. which is annexed as Annexure-4, wherein, she has stated that she has been taken on vehicle by this petitioner and another accused person and she travelled to different places. Learned counsel further submits that both the victim and petitioner were knowing each other and several letters were written by the victim girl to the petitioner. Patna High Court CR. MISC. No.19652 of 2019(2) dt.01-04-2019 2/2 girl, in her statement, has stated her age to be 17 years whereas the court has assessed her age to be 18 years. Learned counsel for petitioner has submitted that compromise has also taken place between the parties. The compromise petition has been filed in the Court below. Petitioner is in custody since 29.01.2019 having clean antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S. Case No. 290 of 2017 subject to the condition that both the bailors shall be the close relative of the petitioner.
