JUSTICE ARUN KUMAR ORAL ORDER 17-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Baghaila PS Case No. 22 of 2017 registered under Sections 307, 341, 323, 354, 447, 504, 506/34 of the IPC and Section 27 of the Arms Act. The allegation is that when the informant went to take the due money then he was assaulted with cricket bat and but of pistol. Submission is that fire arm was not used even despite the opportunity, only allegation is of assaulting by bat and but of the pistol. Only one injury has been found on the head of the informant's father and one injury on the head of the informant. The injuries are not grievous. The petitioner has no criminal antecedent and he is in custody since 7.11.2017.

Having considered the said facts and circumstances, the petitioner, namely, Rahul Tiwari is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Rohtas at Sasaram in connection with Baghaila PS Case No. 22 of 2017.
