Heard learned counsel for the petitioner as well as learned counsel appearing for the Vigilance.
Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 465, 467, 468, 120B of the Indian Penal Code.
Petitioner is not named in the first information report but from perusal of the impugned order, I find that the name of petitioner was proposed as Member of Managing Committee but the said proposal was kept in abeyance by the officials of Board. Moreover, it would also appear from the impugned order that
Patna High Court Cr.Misc. No.36871 of 2016 (3) dt.05-09-2016 2/2 petitioner has been made accused in this case only on the suspicion that she was found in constant touch with main accused of the present case, namely, Bachha Rai during examination and furthermore she accepted her involvement in the present crime before the police.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that having more or less similar allegation, one co-accused, Nand Kishore Yadav has already been granted privilege of bail by the learned Special Judge, Vigilance-I, Patna vide order dated 05.08.2016, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance-I, Patna in connection with Special Case No. 32 of 2016 arising out of Patna Kotwali P.S.
