JUSTICE SHIVAJI PANDEY ORAL ORDER 15-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking bail in connection with Dhansoi P.S. Case No. 120 of 2014 registered for offences under sections 409/420/34 of the Indian Penal Code. As per the allegation, the petitioner has committed irregularity in purchase of solar lamps during the financial year 2006-07 to 2008-09, amount comes to Rs. 11,42,500/-. Altogether three persons have been made accused in this transaction, first the, present petitioner, another Mahesh Prasad and third Ram Prayag Singh. The present petitioner is Panchayat Secretary, another is Mukhiya and Ram Prayag Singh is predecessor of the petitioner. Two persons, namely, Mahesh Prasad-Mukhiya of Gram

Patna High Court Cr.Misc. No.27139 of 2016 (2) dt.15-07-2016 2/2 Panchayat and Ram Prayag Singh have already been granted anticipatory bail by this Court in Cr. Misc. Nos. 34104 of 2015 and 7084 of 2015.

Looking to the facts and circumstances of the case, let the petitioners, above named, be released on bail on their furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Dhansoi P.S. Case No. 120 of 2014, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate in the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
