The petitioner seeks bail in Bihpur (Jhandapur) P.S. Case No. 181 of 2014 registered for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleged that the deceased was driving a machine for construction of road. Four persons came near the cabin and one of them entered into the cabin and fired causing death of the deceased (Lokesh Meshran) on the spot. Learned counsel for the petitioner submits that one Sunil Jha @ Bijali Jha was apprehended and he confessed his guilt. Sunil Jha @ Bijali Jha disclosed the name of Aman Kumar Jha. Aman Kumar Jha also confessed his guilt and he disclosed the

Patna High Court Cr.Misc. No.35194 of 2016 (4) dt.08-11-2016 2/2 name of the petitioner. Aman Kumar Jha has already been granted bail vide order dated 13.05.2016 passed in Cr. Misc. No. 14408/2016 and another accused Balram Rai has also been granted bail vide order dated 20.08.2016 passed in Cr. Misc. No. 35888/2016. The case of the petitioner stands on the better footing. There is no material to connect the involvement of the petitioner, save and except the confessional statement of Aman Kumar Jha, who has already been granted bail. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Naugachia, Bhagalpur in connection with Bihpur (Jhandapur) P.S. Case No. 181/2014.
