Mr. SRI SHYAMESHWAR DAYAL ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 15-01-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Marauna P. S. Case no. 56 of 2017 registered for the offences punishable under Sections 447, 448, 341, 323, 324 and 302 of the Indian Penal Code r/w 32 of the Indian Penal Code. Farebeyan was recorded on 10.05.2017 by wife of deceased ,namely, Tara Devi, in which she has stated that some persons, namely, Ganga Pd. Sah, Shankar Pd. Sah, along with other accused persons came to the house of the informant and assaulted her husband. There is no specific allegation of overt act against the petitioner. In the FIR it is alleged that accused Ganga Prasad inflicted wooden stick blow upon the head of the deceased and petitioner subsequently also assaulted the deceased. As per post mortem examination report, cause of
Patna High Court Cr.Misc. No.60264 of 2017(3) dt.15-01-2018 2/2 death is head injury and petitioner is in custody since 17.05.2017. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Marauna P. S. Case no. 56 of 2017.
