The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 337, 307, 427 and 504/34 of the Indian Penal Code. It is alleged that the petitioner gave threatening to Sunil Singh when co-accused Nirbhay Singh assaulted Ajit Kumar Singh with iron rod on the head whereas petitioner snatched wallet of Ajit and Nirbhay Singh snatched wrist watch of Dablu Singh.
It is submitted by learned counsel for the petitioner that injury report of the informant does not reflect any injury on the head and all the injuries have been found
Patna High Court Cr.Misc. No.34413 of 2015 (2) dt.14-08-2015 2/2 superficial simple in nature. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Moreover, for the occurrence of 26.06.2014 at 8.00 P.M. the FIR was registered on 27.06.2014 at 13.30 P.M. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Muffasil P.S. Case No. 149 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
