Petitioner seeks bail in a case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

The petitioner is full-brother of deceased Nityanand Kumar. The informant is wife of Nityanand Kumar. She has alleged that the petitioner and his wife had assaulted to the mother-in-law of the informant and for that reason, the deceased had some hot discussion with the petitioner and his wife as a result whereof the petitioner and his wife throttled the deceased to death. The wife of the petitioner was granted anticipatory bail by a Coordinate Bench of this Court vide order dated 09.11.2017 passed in Cr. Misc. No. 45573 of 2017 vide

Patna High Court Cr.Misc. No.58266 of 2017 (2) dt.12-12-2017 2/2 Annexure-2.

Considering the material in the case diary that mother of the deceased has stated before the police that the deceased had some differences with his wife (the informant of this case) and for that quarreling, the deceased committed suicide, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Arwal Police Station Case No. 121 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
