The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 366A/34 of the Indian Penal Code and Section 12 of the POCSO Act.

In pursuance to the order dated 27.07.2022, status report of trial in connection with Sahayak Nagar P.S. Case No. 40 of 2020 has been received and kept at Flag-A, in which it is reported that there are two accused namely Laxman Paswan and Muni Devi in this case. Laxman Paswan is in judicial custody and Muni Devi is on provisional bail. Cognizance has already been taken vide order dated 27.05.2020. Police paper were handed over to them on 07.07.2020. Accused Muni Devi was released on 23.07.2020 from judicial custody on bail. Record is running for hearing on the point of charge since then but Muni Devi is absent and lastly, her bail bond was cancelled. At present

Patna High Court CR. MISC. No.19471 of 2022(5) dt.24-08-2022 2/2 case is running for appearance of accused Muni Devi and after her appearance, minimum three months time is required for conclusion of trial.

Considering the present stage of the trial, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Sahayak Nagar P.S. Case No. 40 of 2020 pending before the court of the learned A.D.J.-1cum-Special Judge, Katihar. Accordingly, the application is dismissed.
