Petitioner seeks bail in anticipation of her arrest in connection with Phulwarisharif P.S. Case No. 74 of 2019, registered for the offences punishable under Sections 307, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation as per FIR is that while the informant was coming by car accused persons intercepted her car and fired at her, causing injury to her and anyhow she managed to save her life. Further allegation is that after death of 1st husband she married with another person and later on she came to know the person is married and his wife is alive and there is family dispute with respect to property. It is also alleged in the FIR that earlier petitioner has sent a e-mail on the I.D. of the informant and threatened her.

No.14878 of 2019(3) dt.01-04-2019 2/2 Submission of learned counsel for the petitioner is that except the story of sending of e-mail there is nothing against the petitioner and she is a lady studying in MD at Noida. Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail stating that there was conspiracy in the case and there is involvement of the petitioner in the said conspiracy.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Judge-XV-cum-A.C.J.M., Patna, in connection with Phulwarisharif P.S. Case No. 74 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
