JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 353, 420, 427, 457, 120B/34 of the Indian Penal Code. Petitioner was General Manager of Riga Sugar Company Limited and it is alleged that the premises of the aforesaid Company was sealed after complete prohibition in the State but on 24.5.2016, the informant got a confidential information that the seal of aforesaid Company had been broken and thereafter, he went at the premises of the aforesaid Company situated at Muzaffarpur and found Indian Made Foreign Liquor in huge quantity in the said premises.

Patna High Court Cr.Misc. No.29003 of 2016 (2) dt.25-07-2016 2/2 Submission on behalf of the petitioner is that the petitioner was not present on the place of occurrence and so far as the so-called recovery is concerned, he was not present rather at the relevant time, he was posted at Riga, Sitamarhi whereas the godown of Muzaffarpur had been sealed. Moreover, petitioner is languishing in jail custody since 16.6.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Muzaffarpur in connection with Musahari P.S. Case No.68 of 2016.
