2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code.
3. As per F.I.R., petitioner Nos. 1, 2 and 3 are alleged to have assaulted the informant by means of iron rod and petitioner No. 4 is alleged to have cut the finger of the cousin brother of the informant due to which they sustained injuries.
4. It is submitted on behalf of the petitioners that the
Patna High Court CR. MISC. No.21747 of 2024(2) dt.04-04-2024 2/2 petitioners are innocent and has falsely been implicated in this case. Injury caused by petitioner Nos. 1, 2 and 3 are found to be simple in nature. Although there is allegation against petitioner No. 4 that he caused cut injury to the cousin brother of the informant but there is no injury report on the record of the cousin brother of the informant. Petitioners claim clean antecedent.
5. Learned counsel for the State oppose the bail petition.
6 Considering the nature of injury and clean antecedent of the petitioners, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate - 1st Motihari, East Champaran in connection with Govindganj (Malahi) P.S. Case No. 556 of 2022 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure . (Prabhat Kumar Singh, J) Koushik/- U T
