JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-07-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Didarganj P.S. Case No. 85 of 2016 registered under Section 395 of the Indian Penal Code.

The accusation is that, on 07.04.2016, 15 to 17 miscreants entered in the house of informant and committed Dacoity of house hold articles and ornaments. Thereafter, they moved from the back door of the house. The informant claimed to identify four persons including the petitioner as they are neighbour and running Chomine shop in front of the house. Learned counsel for the petitioner submits that petitioner, co-accused Kanhiya Sao and Rajan Kumar are own

No.27968 of 2016 (2) dt.15-07-2016 brothers and they are running the Chomin shop in front of the house of the informant and due to ulterior motive they have falsely been implicated in this case. It is further submitted that it is beyond imagination that the neighbour would commit the Dacoity without concealing their identity. It is further submitted that petitioner has no criminal antecedent and is in custody since 09.04.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Patna City, Patna, in connection with Didarganj P.S. Case No. 85 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
