2. The present modification application has been filed for modify the order dated 07.02.2024 in Cr. Misc. No. 3319 of 2024 by which the petitioner has been granted the privilege of anticipatory bail subject to condition "that the petitioner shall return Rs. 3,00,000/- to the complainant subject to the result of the case".

3. Learned counsel for the petitioner submits that the petitioner has never received any money from the complainant

Patna High Court CR. MISC. No.30954 of 2024(2) dt.26-04-2024 2/2 and he has never given his consent to give Rs. 3,00,000/- to the complainant nor he has given any undertaking to his counsel to give an undertaking on behalf of the petitioner to give Rs. 3,00,000/- to the complainant.

4. It appears that the aforesaid order was passed on the consent given by the counsel for the petitioner and order dated 07.02.2024 was passed in presence of counsel for the petitioner.

5. In view of the aforesaid, the modification petition stands dismissed.
