The petitioner seeks regular bail in connection with Jogbani P.S. Case No. 198 of 2017 corresponding to Special Case No. 3189 of 2017 for the offences punishable under Sections 272/273 of the Indian Penal Code and Section 30(a)/38(i) of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 45 liters of illicit Nepali wine from the cycle of the petitioner. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and no recovery has, in fact, been made from conscious possession of the petitioner. Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 2nd Addl Sessions Judge, Araria in connection with Jogbani P.S.
