The petitioners are apprehending arrest in a case registered for the offences punishable under Section 304/34 of the Indian Penal Code.

The prosecution case is that the petitioners operated the wife of the informant and one male child was born on 14.03.2014 at 06:00 pm but the wife of the informant died during operation. It is submitted by learned counsel for the petitioners that the operation was done by Dr. M. S. Hoda, who issued the certificates to that effect, and father of the informant executed the bond permitting Dr. M. S. Hoda to operate, both the documents have been brought on record as annexure 2 series. Moreover, the informant has

Patna High Court Cr.Misc. No.33803 of 2015 (2) dt.02-09-2015 2/2 retracted from initial version and has filed a petition to that effect before the learned court below, the same has been brought on record as annexure-3 to the petition.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Bagaha, West Champaran in connection with Bagaha (Patkhauli) P.S. Case No.130 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
