Petitioner prays for bail in connection with Sessions Trial No. 1040 of 2002, arising out of Bhargama P.S.Case No. 15 of 2002 registered for the offence punishable under Section 395 of the Indian Penal Code.
This is a case of misuse of privilege of bail and earlier prayer for bail of the petitioner was rejected by the then coordinate Bench of this Court vide order dated 9.7.2018 passed in Cr.Misc.No. 23277 of 2018 with a liberty to renew his prayer for bail after framing of charge.
Submission of learned counsel for the petitioner is that charge has been framed in this case on 11.8.2018 and he is in custody since 14.2.2018.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-I, Araria, in connection with Sessions Trial No. 1040 of 2002, arising out of Bhargama P.S.Case No. 15 of 2002, subject to the condition that one of the bailors shall be a family member of the petitioner and petitioner has to appear in court as and when required, otherwise his bail bond shall be cancelled.
