The petitioner is in custody since 13.11.2017 in connection with Kumarkhand P.S. Case No.249 of 2017 S.T. No.111/2018, registered for the offence under Sections 302, 201 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected by this Court, but considering the period of custody, he may be extended the privilege of bail.

A report had been called for from the court of 1st Additional Sessions Judge-Cum-Special Judge, Madhepura, which has since been received, in which it has been stated that out of total 8 P.Ws., including Doctor and I.O., four witnesses

Patna High Court CR. MISC. No.26544 of 2019(3) dt.17-05-2019 2/2 have been examined and rest are likely to be examined shortly. It appears from the aforementioned report that the trial has advanced substantially and is likely to be concluded at an early date.

Accordingly, while rejecting the prayer for bail of the petitioner, the trial court is directed to expedite the trial on day to day basis without giving any unnecessary adjournment, so that the same may be concluded by the 31st of October, 2019. (Anjana Mishra, J) PNM U T
