The State of Bihar. .... .... Opposite Party ====================================================== Appearance :

For the Petitioner/s : Mr. Raj Kishor Prasad For the Opposite Party/s : Mr. Sri Anuj Kumar Srivastava ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 17-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Deepnagar PS Case No. 196 of 2017 (S.Tr. No. 663 of 2017) registered under Section 302 of the IPC.

The allegation in brief is that there was strained relationship between the petitioner and his wife, he is alleged to have killed his wife by throttling, he was alone with his wife in the house and apprehended by the local people.

Learned Counsel for the petitioner submits that there is no eye witness in the case, had he killed his wife he would have escaped away but would not have been present there, perhaps some other person has killed his wife and got the petitioner falsely implicated. Learned Counsel for the State submits that there is specific allegation against this petitioner, he was apprehended by the local people and he was alone with his wife in the house. Having considered the said facts and circumstances, the prayer for bail of the petitioner is rejected. Snkumar/- (Arun Kumar, J.) U T
