JUSTICE SANJAY PRIYA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sultanganj P.S. Case No. 28 of 2017 instituted for the offence under Section 392 of the Indian Penal Code.
Counsel for the petitioner submits that there is no recovery of any incriminating article from possession of the petitioner. The petitioner has not been put on Test Identification parade. The name of petitioner has come during investigation on the basis of confessional statement of co-accused Saket Kumar. The First Information Report is against unknown. Counsel for the petitioner further submits that petitioner is in custody since 10.06.2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the
Patna High Court Cr.Misc. No.55413 of 2018 (2) dt.20-09-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Bhagalpur, in connection with Sultanganj P.S.
