Learned counsel for the petitioners submits that petitioner no.1 Najbun Hoda alias Najmul Hoda has died and hence, his anticipatory bail application has become infructuous and accordingly, the same is dismissed.

During the course of argument, it transpired that the entire bail petition has wrongly been typed and as such, learned counsel for the petitioners seeks permission to withdraw this petition to enable him file a fresh one, if so advised. Accordingly, the prayer is allowed and the bail petition is dismissed as withdrawn.
