Petitioner seeks bail in Sadar P.S. Case No. 175 of 2018 registered for the offence punishable under Sections 414, 399, 402 of the Indian Penal Code and Section 25(1-B)a, 26 and 35 of the Arms Act.

Allegation against the petitioner is of recovery of one loaded pistol with one live cartridge, while he alongwith other co-accused named in the FIR were preparing for committing grave crime. Out of five culprits three managed to escape and petitioner and one another was apprehended at the spot. It has been submitted on behalf of the petitioner that petitioner has committed no offence and has been falsely

Patna High Court Cr.Misc. No.54903 of 2018(2) dt.14-09-2018 2/2 implicated in this case. It has been further submitted that the petitioner was not arrested at the spot rather he was arrested when he was on his way to his sister's house. Petitioner is in custody since 20.03.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Sadar P.S. Case No. 175 of 2018.
