JUSTICE PRABHAT KUMAR JHA ORAL ORDER 13-12-2017 Heard Mr. Akhileshwar Prasad Singh, learned Senior Counsel appearing on behalf of the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks bail in Uphara P.S. Case No. 30 of 2016, registered for the offences punishable under Sections 302 and 34 of Indian Penal Code.
The petitioner's prayer for bail was earlier rejected vide order, dated 10.04.2017, passed in Cr. Misc. No. 1164 of 2017.
Mr. Akhileshwar Prasad Singh, learned Senior
Patna High Court Cr.Misc. No.56864 of 2017 (2) dt.13-12-2017 2/2 Counsel appearing on behalf of the petitioner, submits that the petitioner is in jail for more than a year. He submits that the petitioner has falsely been implicated in the case, but it appears that none than the son of the petitioner made specific allegation that the petitioner was assaulting his wife and when the wife of the petitioner was going to her Naihar, the petitioner pulled her from the bus and sprinkled kerosene oil on the body and ignited fire. Consequently, the mother and brother Abhay Kumar of the informant sustained burn injuries. The daughter of the deceased also got burn injures and she also reiterated the same facts. Considering the gravity of the offence and the allegations made against the petitioner, I am not inclined to enlarge the petitioner, above named, on bail. The same is, accordingly, once again rejected.
