The petitioner is apprehending his arrest in connection with Jainagar P.S. Case No.178 of 2014 for allegedly having committed the offence under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. Learned counsel for the petitioner submits that there is a case and counter case between the parties and that there is no specific allegation against this petitioner. So far as the injuries purported to have been inflicted upon the informant are concerned, they do not match with the allegations made in the F.I.R.
Considering the aforementioned facts and
Patna High Court Cr.Misc. No.33162 of 2015 (2) dt.24-08-2015 2/2 circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Madhubani, in connection with Jainagar P.S. Case No.174 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
