The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366A, 504, 506, 34 of the Indian Penal Code and Section 8 of the POCSO Act.

As per prosecution case, minor girl of the informant has been kidnapped by F.I.R. named accused persons including the petitioner.

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The petitioner has no criminal antecedent as stated at para 3 of the bail petition.

The victim in her statement recorded under Section 164 Cr.P.C. has denied her kidnapping and stated that she out of

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge-cum-Special Judge, POCSO Act, East Champaran at Motihari, in connection with Kalyanpur P.S.
