The petitioner is apprehending his arrest in a case registered for the offences punishable under sections 272, 273 of the Indian Penal Code and 47 A of the Excise Act. The allegation against the petitioner is that he along with other co-accused was involved in manufacturing of illicit liquor. It is also alleged that machine and implements were recovered from the place of seizure.
It is submitted by the learned counsel for the petitioner that nothing was recovered from the conscious possession of the petitioner and due to enmity he has been implicated in this case. It is also submitted that the place of
Patna High Court Cr.Misc. No.33047 of 2015 (2) dt.11-08-2015 2/2 occurrence does not belong to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Gaya Mufassil P.S. Case No. 165 of 2015, pending in the court of learned C.J.M, Gaya.
With the aforesaid observation, this application is disposed of.
