The petitioner seeks bail in a case instituted for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47(A) of the Bihar Excise (Amendment) Act, 2016.

72 bottles containing 180 ml. each of Indian made foreign liquor are said to have been recovered from bush cart which was found situated beside the home of the petitioner. Submission on behalf of the petitioner is that the aforesaid recovery has neither been made from conscious possession of the petitioner nor from his house and as a matter of fact, he has been implicated in this case on account of political rivalry.

Considering the aforesaid facts and circumstances as

No.31437 of 2016 (3) dt.12-08-2016 2/2 well as submissions made by the parties, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Samastipur in connection with Tajpur (Halai O.P.) P.S. Case No. 163 of 2016.
