JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-401/34 of the Indian Penal Code.

The petitioner is languishing in jail custody since 0403-2016 on the accusation that he as well as one other accused was caught by the passengers, while they were roaming on the platform for committing theft.

Submission on behalf of petitioner is that the petitioner was caught on mere suspicion and nothing was recovered from conscious possession of the petitioner.

Considering the above-said facts and circumstances of

Patna High Court Cr.Misc. No.28093 of 2016 (3) dt.26-09-2016 2/2 the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with G.R.P. Police Station Samastipur Case No. 10 of 2016 to the satisfaction of Railway Judicial Magistrate-Ist Class, Samastipur.
