JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code.

Prosecution case is that informant got information that her husband met with an accident and was lying on the road. She rushed there and took him to hospital where it was declared that his death was caused by gun shot injury.

It has been submitted on behalf of the petitioner that he is in custody since 22.3.2016. Chargesheet has been submitted against the petitioner. There is no allegation of tampering of witnesses against the petitioner. He is not named in the F.I.R. There is no eye witness to the alleged occurrence. There is no motive alleged against the petitioner. A suspicion has been raised in paras-25 and 27 of the case diary. Except for suspicion, there is no other material to suggest his implication in the present case. On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.32011 of 2016 (3) dt.16-09-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City, Patna, in connection with Menhadiganj P.S. Case no. 28 of 2016.
