Petitioner prays for bail in connection with Mojahidpur (Babarganj) P.S.Case No. 03 of 2018, corresponding to Sessions Trial No. 382 of 2018, registered for the offences punishable under Sections 364, 307 and 379/34 of the Indian Penal Code. Allegation against the accused persons, including the petitioner is of kidnapping and assaulting the victim. Submission of learned counsel for the petitioner is that FIR itself shows that main allegation is against other accused persons and allegation against the petitioner is general and omnibus in nature. Further submission is that he has been made accused in two other cases and he is on bail in those cases and petitioner is in custody for seven months.

Having heard both sides and in view of nature of allegation and criminal antecedents, I am not inclined to grant bail to the petitioner.

However, once charge has been framed in this case, petitioner may renew his prayer for bail.
