Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner is in custody since 25.05.2019 and seeks bail in connection with Bettiah (Town) P. S. Case No.402 of 2019 registered for the offences punishable under Sections 366(A)/ 34 of the I.P.C. and Section 8 of the POCSO Act. The statement of victim has been recorded under Section 164 of the Cr.P.C. in which victim stated that this petitioner took her to his house and, subsequently, one Yusuf
Patna High Court CR. MISC. No.20683 of 2020(2) dt.04-09-2020 2/2 Raja took her to Nawalpur where she was confined in a room by a woman and, subsequently, she was allowed to go on a tempo and, thereafter, she was brought to police station. The victim has specifically stated that she was not misbehaved by the petitioner and others.
Considering the aforesaid facts and circumstances of the case as well as period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, (SC/ ST/ POCSO), Bettiah, West Champaran in connection with Bettiah (Town) P. S. Case No.402 of 2019.
