Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Laheriasarai (Benta O.P.) P.S. Case No. 367 of 2013 dated 22.08.2013 lodged under Sections 420, 406, 467, 468, 471, 120(B)/34 of the I.P.C.
The present F.I.R. has been lodged by the S.H.O., Laheriasarai P.S. against 6 named accused persons who were running company namely, Vishwamitra India Parivar and used to collect money from the different customers. It has been alleged in the F.I.R. that company is involved in cheating the
Patna High Court CR. MISC. No.20743 of 2023(2) dt.05-06-2023 2/3 common people by inducing them to make investment in the company on the promise to double the amount in a period of 5 years.
Learned counsel for the petitioner submits that the petitioner is admittedly working as Office Assistant in the said company. Counsel further submits that petitioner is poor employee, who was working on salary basis in the said company. He also submits that there is no specific allegation that petitioner has cheated any one. Counsel further submits that antecedent of the petitioner is clean and he is in custody since 06.02.2023.
Learned counsel for the State opposes the prayer for bail but admits that from the document it transpires that petitioner is working in the said company on salary basis. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai (Benta O.P.) P.S. Case No. 367 of 2013, subject to the conditions as laid down under Section 437(3) of Cr.P.C..
