JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-10-2016 The petitioner is languishing in custody since 17.06.2016 in a case registered for the offences punishable under Sections 8/20(b)(ii)(B)/29/31 of the Narcotic Drugs & Psychotropic Substances Act.

The prosecution case is that the S.H.O of Hajipur Sadar police station received secret information about trafficking of narcotics. Consequently the raid was laid in a thatched hut which belongs to the petitioner from which 2 Kgs of ganja were recovered.

It is submitted by learned counsel for the petitioner that recovery has been made from the in-laws place of the petitioner and the recovery has been made from the hutment which has no door.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.34337 of 2016 (3) dt.27-10-2016 2/2 Learned A.P.P after going through the case diary does not dispute the quantum of recovery. Considering the recovery between small and commercial quantity and the petitioner having no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 49 of 2016.
