JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-11-2018 The petitioner had prayed for bail and had asserted that he has no criminal antecedents. By order dated 20.04.2018, passed in Cr. Misc. No. 23863 of 2018, a Bench of this Court directed the petitioner to be released on bail subject to the verification of his criminal antecedents.

It came to light on verification that the petitioner is accused in two other cases. Hence, the bail order could not be made effective. As a result of this, the present application has been filed for modification of the order, referred to above, for deleting the requirement of verification of the antecedents of the petitioner.

This Court is afraid, such a prayer cannot be

However, taking into account the fact that the petitioner has sought bail in a case instituted for the offences under Sections 379, 461, 411 and 34 of the I.P.C. and the two cases in which he has earlier been made accused are also of similar nature of offences, this Court can only observe that in case the petitioner desires to apply afresh for grant of bail, he may do so. With the aforesaid observation, this application is disposed off.
