The petitioner seeks bail in connection with Ahiyapur P.S. Case No. 640 of 2018 dated 14.06.2018 instituted for the offences under Sections 401 and 411 of the Indian Penal Code.

While investigating Ahiyapur P.S. Case No. 556 of 2018 with respect to snatching of a motorcycle, one Manoj Kumar, an accused confessed about the participation of the petitioner in the aforesaid case. Pursuant to the aforesaid confession, a raid was conducted in the house of the petitioner and the stolen motorcycle was recovered. Hence, the subject FIR. Learned counsel for the petitioner has submitted that after the petitioner was made accused in

Patna High Court Cr.Misc. No.54498 of 2018(2) dt.04-09-2018 2/2 this case, he has been remanded in the case referred to above viz. Ahiyapur P.S. Case No. 556 of 2018 instituted for the offence under Section 392 of the Indian Penal Code. That apart it has been submitted that from the FIR itself, it would appear that though the motorcycle was recovered from the house of the petitioner but it was being driven by two other persons who were found using the motorcycle.

The petitioner is in custody since 15.06.2018 and does not have any other case to his credit except the present one and the one about which the reference has been made above.

For the aforestated facts, the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 640 of 2018.
