JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is named in the First Information Report but it is alleged that the petitioner was going with the deceased by motorcycle and in the meantime, another accused stopped the motorcycle and thereafter, F.I.R. named accused Pawan Kamat and Bhagwan Jha opened fire on the deceased. The fardbeyan of the informant reflects that there is only allegation of conspiracy against the petitioner, who is languishing in jail custody since

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Singh, learned Munsif, Saharsa in connection with Bihra P.S. Case No. 57 of 2016.
