The Petitioner submits that she resides in Jamui and hence, Matrimonial Case No.78 of 2011 be transferred there for her convenience, whereas, the Opposite Party No.2 submits that since he is posted in Jharkhand and he is resident of Buxar, the case should not be transferred to Jamui.
Since the Opposite Party No.2 has to travel in any case either to Buxar or Jamui to pursue the case and it makes no difference for him whether it is pending at Buxar or at Jamui, in the interest of the parties, let Matrimonial Case No.78 of 2011 pending before the Principal Judge, Family Court, Buxar, be transferred to the Court of
Patna High Court Cr.Misc. No.50340 of 2012 dt.21-08-2015 2/2 the Principal Judge, Family Court, Jamui, with the Sessions Division of Jamui district.
The Court below i.e. Principal Judge, Family Court, Jamui, is directed to dispose of the proceeding within a period of three months from the date of receipt of the record without granting unnecessary adjournment to any party.
Counsel for the Opposite Party No.2 undertakes to cooperate before the Court below to ensure the disposal of the case within the time frame.
The application stands disposed off.
